Former Florida Lawmaker Joe Harding, Sponsor of Controversial “Don’t Say Gay” Law, Sentenced to Prison for COVID Loan Fraud

Former Florida GOP Representative Joe Harding, known for sponsoring the controversial “Don’t Say Gay” law, has been sentenced to prison for his involvement in a COVID loan fraud case. Harding pleaded guilty in March to charges including wire fraud, money laundering, and making false statements related to a plot to fraudulently obtain a $150,000 federal COVID relief loan. The US Attorney’s Office for the Northern District of Florida disclosed that Harding has been sentenced to four months in federal prison, followed by two years of supervised release.

Harding, who championed the bill that restricted classroom instruction on sexual orientation and gender identification, will also be required to make restitution for the fraudulently obtained loan. He is scheduled to surrender to authorities on January 29 to begin his prison term. The sentencing marks a significant blow to Harding’s political career, leaving behind a tainted legacy of deception and greed.

U.S. Attorney Jason Coody expressed disappointment at the situation, stating that the theft of taxpayer funds is inexcusable, particularly during the pandemic. Special Agent in Charge Brian J. Payne of the IRS Criminal Investigation in the Tampa Field Office condemned Harding’s actions as a betrayal of the public trust, emphasizing that he had stolen funds meant to aid those who had elected him.

Harding’s fraudulent activities involved the use of false bank statements for two dormant small businesses to secure loans during the pandemic. Despite the businesses being inactive, he misrepresented the facts to the Small Business Administration, falsely claiming significant revenue and employees. This deception undermined the purpose of the federal Paycheck Protection Program, which aimed to provide support to businesses during the challenging times of the COVID-19 pandemic.
