Connecticut business owner and former alderman, Gene DiGiovanni Jr., has been sentenced to 10 days in jail for his participation in the assault on the U.S. Capitol over three years ago. Chief Judge James Boasberg handed down the sentence and also ordered DiGiovanni to perform 50 hours of community service. The attack occurred on January 6, 2021, during then-President Donald Trump’s “Stop the Steal” rally near the White House.
DiGiovanni, hailing from Derby, Connecticut, attended the rally before joining the mob that stormed the Capitol building through the Upper West Terrace door. He spent approximately 22 minutes inside the Capitol before exiting the building. Prosecutors noted that DiGiovanni did not leave the grounds but instead remained on the East Front steps, where he celebrated by raising his arm in the air.
DiGiovanni was charged with entering or remaining within a restricted building or grounds, a misdemeanor that carries a maximum penalty of one year in prison. Prosecutors had recommended a 30-day imprisonment, while defense attorney Martin Minnella argued for no jail time. Minnella stated that DiGiovanni was merely a follower and had no intention of participating in any insurrection.
In a statement following the sentencing, Minnella expressed gratitude on behalf of DiGiovanni and his family, stating that they are relieved this dark chapter in his life has come to an end. DiGiovanni, a contractor who owns a construction business, had previously served as an alderman in Derby and even ran for mayor of the city after the Capitol riot.
This case is part of the larger investigation into the Capitol riot, with over 800 individuals charged with federal crimes related to the event. Approximately two-thirds of those charged have already been sentenced, receiving imprisonment terms ranging from a few days to longer periods.
