Supreme Court Extends Delay in Trump Criminal Case, Citing Absolute Immunity for Former Presidents

The Supreme Court has issued a historic ruling, extending the delay in the criminal case against former President Donald Trump in Washington. The charges against Trump allege that he plotted to overturn his 2020 presidential election loss. In a 6-3 decision, the justices declared that former presidents have absolute immunity from prosecution for their official acts, but no immunity for unofficial acts. This ruling effectively ends the possibility of Trump facing trial before the upcoming November election.

Chief Justice John Roberts, writing for the court, stated that under the constitutional structure of separated powers, a former president is entitled to absolute immunity from criminal prosecution for actions within their constitutional authority. However, they are only entitled to presumptive immunity for their official acts, with no immunity for unofficial acts. The conservative justices, including Roberts, supported this interpretation, while the three liberal justices dissented.

Justice Sonia Sotomayor, in a scathing dissent, criticized the decision, stating that granting former presidents criminal immunity undermines the principle that no one is above the law. She argued that the protection afforded to presidents by the court is baseless and detrimental to the institution of the presidency.

The ruling comes after a significant delay, with the court taking more than two months to issue its decision. Trump has consistently denied any wrongdoing and has claimed that the prosecutions against him, including this case brought by special counsel Jack Smith, are politically motivated attempts to prevent his return to the White House.

In May, Trump became the first former president to be convicted of a felony in a New York court. He was found guilty of falsifying business records to conceal a hush money payment made during the 2016 presidential election. Trump still faces three other indictments, including the Washington case, which focuses on his alleged efforts to overturn the 2020 election results.

If Trump’s trial in Washington does not take place before the 2024 election and he is not reelected, he could potentially face trial soon after. However, if he wins, he could appoint an attorney general who might seek the dismissal of this case and other federal prosecutions. Additionally, he could attempt to pardon himself if he regains the presidency, although he would not be able to pardon himself for the conviction in the New York state court.

The Supreme Court’s involvement in this case, along with its previous ruling rejecting efforts to bar Trump from the ballot due to his post-election actions, highlights the direct and potentially uncomfortable role the justices are playing in the upcoming November election.

The court’s decision was the final ruling of the term and marks a significant development in the ongoing legal battles surrounding the former president. The delay caused by the Supreme Court’s order for lower courts to determine how to apply the ruling to Trump’s case means further postponement before a potential trial can take place.
