Haitian Migrant Accused of Rape Released on Bail Despite ICE Request

A Haitian migrant, Cory Alvarez, who stands accused of raping a 15-year-old girl at a shelter in Rockland, Massachusetts, has been released on bail despite a request from Immigration and Customs Enforcement (ICE) to hold him. Alvarez, 26, had been held without bail since his arrest in March but was granted release on a $500 bail by the Plymouth County Superior Court on Tuesday. The court ignored the request from ICE and the $25,000 bail requested by prosecutors, as reported by the Boston Herald and the Boston Globe.

Plymouth County DA Tim Cruz’s pre-trial motion to keep Alvarez in jail was also denied, leading to his release. However, Alvarez was ordered to wear an ankle monitor and surrender his passport. He is required to check in twice monthly with probation and is due back in court on August 13.

The release of Alvarez has raised concerns among ICE officials, who are unable to track him due to Boston being a sanctuary city. ICE had filed an immigration detainer against Alvarez with the Plymouth County Sheriff’s Office, but the detainer was not honored by the Plymouth Superior Court.

Critics argue that the release of Alvarez highlights a concerning trend of inadequate vetting procedures and raises safety concerns for US citizens. Former ICE field office director John Fabbricatore expressed his worries about the rushed process and the potential risks it poses to law-abiding citizens.

Alvarez entered the US in June 2023 under President Biden’s parole program for Cubans, Haitians, Nicaraguans, and Venezuelans (CHNV). Despite his entry documents indicating that he would be living with a sponsor in Elizabeth, NJ, Alvarez ended up at the Comfort Inn in Rockland, which had been converted into a migrant shelter. He was arrested on March 13 at the shelter in connection with the rape of a disabled teenage girl.

The victim reported the incident to investigators at South Shore Hospital, stating that she had asked Alvarez to leave her alone, but he did not stop. Alvarez has pleaded not guilty to one count each of aggravated rape of a child with a 10-year age difference and rape of a child by force.

The case has drawn attention from Rep. Jim Jordan (R-Ohio), who has initiated an inquiry into the CHNV program. The release of Alvarez has sparked criticism of sanctuary city policies, with concerns raised about the protection provided to foreign-born criminals rather than law-abiding citizens.

The Plymouth County DA’s Office did not respond to requests for comment. ICE sources expressed frustration with what they referred to as “standard Democratic bulls–t,” which hampers their ability to carry out their duties effectively. They also highlighted the lack of cooperation from certain states, including California, New York, Illinois, and Massachusetts, which have policies preventing the sharing of information.
