China Grapples with Lenient Sentencing for Juvenile Killers

China is facing a disturbing trend of shocking murders committed by young boys, some as young as 12, against little girls. However, equally shocking is the lenient approach taken by the communist nation in dealing with these juvenile killers, often allowing them to escape jail time. Instead, they are often sent to mental institutions for just a few years, leaving the parents of the victims waiting for justice that may never come.

Gong Junli, a single father, is among the heartbroken parents seeking justice for his 8-year-old daughter who was brutally stabbed to death by a 13-year-old boy. The incident occurred in the Xinjing Township in September 2022, when the boy allegedly lured the girl into the woods and stabbed her multiple times before abandoning her body. Investigators discovered that the boy had prepared tools for the murder, showing a lack of remorse during police questioning. Junli’s surveillance camera captured the moment the young girl was lured away by the teenager, who had made previous attempts to coax her into the woods.

Junli’s case is not an isolated incident. In a similar case from last year, a 4-year-old girl was killed by a boy under 12 years old who pushed her into a manure tank near her home in Hubei. However, the case against the boy was dropped due to his age, leaving the father still seeking justice for his daughter’s death. The lenient sentencing is a common practice in China, even prior to the 2021 amendment that lowered the age of criminal responsibility to 12. In another case, a 13-year-old boy received only three years at a juvenile rehabilitation center after raping and fatally stabbing a 10-year-old girl in 2019.

The outrage over these cases led to the 2021 amendment, but China continues to witness an increase in cases involving juvenile offenders. Between 2020 and 2023, prosecutors charged 243,000 minors, with an average annual increase of 5%. The Supreme People’s Court (SPC) recently announced that it had sentenced 12,000 minors in the first three months of 2024, including four minors aged between 12 and 14 who received 10 to 15 years in prison. However, the specific crimes committed by these minors were not disclosed.

In response to the rising juvenile crime rates, the SPC issued new guidelines suggesting that parents and guardians could be held responsible for their children’s actions. The court highlighted that a significant number of violent offenders came from “left-behind” or single-parent families, emphasizing the need for collaborative efforts by schools, families, social organizations, and government agencies to address bullying and prevent such incidents from occurring.

The spate of violent incidents has sparked calls for parents to prioritize raising their children and keeping them out of trouble. The Supreme People’s Court has urged communities to come together and address the issue, emphasizing the importance of early intervention to tackle bullying and related problems.
