A United Nations-backed Commission of Inquiry has released a report accusing both Israel and Palestinian groups, including Hamas, of committing war crimes during the eight-month conflict in Gaza. The report covers the period from the Hamas-led attack on southern Israel on October 7 to Israel’s subsequent war on Gaza, ending on December 31, 2023.
The report provides graphic details of sexual violence, torture, and mutilations carried out on unarmed citizens. It accuses the Hamas-led Palestinian fighters of committing war crimes by failing to distinguish between Israeli combatants and non-combatants during their attack on October 7. The report also finds that Israel and its army are committing “crimes against humanity” in Gaza, including murder, gender persecution targeting Palestinian men and boys, forcible transfer, and torture.
Israel’s response to the attack was also criticized, with the report highlighting the use of the Hannibal Directive by the Israeli army, which resulted in the killing of at least 14 Israeli civilians. The report further states that Israel imposed a total siege on Gaza as collective punishment, referring to the people as “human animals.”
The Israeli government’s efforts to “minimize civilian casualties” were heavily criticized, with unclear instructions and insufficient time given to civilians to reach humanitarian zones. Evacuation routes were chaotic, and evacuees faced harassment at checkpoints by Israeli military personnel. The report also highlights widespread sexual and gender-based violence, as well as torture, as characteristic of the Israeli response.
The Commission’s attempts to investigate were met with cooperation from the Palestinian Authority, while the Israeli government failed to respond to requests for information and blocked access to medical staff within Israel.
