Two Maine Men Sentenced for Racist Attack Resulting in Victim’s Broken Jaw and $1 Million in Damages

In a significant ruling, two white men from Biddeford, Maine, Maurice Diggins and his nephew Dusty Leo, have been ordered to pay over $1 million in damages for a racially motivated attack on a Black man, Daimon McCollum. The incident, which occurred in April 2018, resulted in McCollum sustaining a broken jaw.

The attack happened outside a 7-Eleven store where McCollum was subjected to racial slurs and physical violence. According to reports, Diggins, who sports a “White Pride World Wide” tattoo, and Leo confronted McCollum, with Leo striking him in the jaw. McCollum, who had just celebrated a college scholarship for one of his children, ran home but alleged that the assailants followed him. The pair were later arrested and faced federal charges.

At their trial in March 2020, McCollum testified about the extent of his injuries, including a broken jaw that required his mouth to be wired shut for a month. In response to the assault, McCollum filed a civil lawsuit against Leo and Diggins seeking damages for medical costs and emotional distress.

The court, presided over by Judge Mulhern, ordered Diggins and Leo to pay $700,000 in punitive damages and $500,000 in compensatory damages after a hearing. The defendants, who did not attend the hearing, had previously opposed the charges in handwritten responses and requested deferment of pretrial deadlines until they could find legal representation or be released.

Although acknowledging that Diggins and Leo might not have the means to pay the entire amount, McCollum’s attorney, Allyson Knowles, noted that there are civil procedures to determine what assets the defendants have and what can be seized for payments.

Diggins is currently serving a 10-year federal prison sentence, while Leo, who delivered the critical punch, received a three-year sentence and is expected to be released soon.
