PANAMA CITY — The trial of 27 individuals, including the owners of the Mossack-Fonseca law firm, commenced on Monday in a Panamanian criminal court. This trial is in connection with the infamous “Panama Papers” money laundering scandal that shook the world in 2016. The leaked documents, totaling 11 million secret financial records, exposed the intricate web of how some of the wealthiest individuals conceal their wealth.
The repercussions of the Panama Papers leak were extensive, leading to the resignation of Iceland’s prime minister and casting a spotlight on the leaders of Argentina, Ukraine, Chinese politicians, and Russian President Vladimir Putin, among others. The trial, which has faced numerous delays, began with the presence of Juergen Mossack in the courtroom, while Ramón Fonseca’s lawyers stated that he was in a hospital in Panama.
The case revolves around allegations that the Mossack-Fonseca law firm established shell companies to acquire properties in Panama using funds from the sprawling Brazilian corruption scheme known as the Car Wash, or Lava Jato. Fonseca has maintained that the firm had no control over how its clients utilized the offshore vehicles created for them. Both Mossack and Fonseca, who hold Panamanian citizenship, were acquitted of other charges in 2022. It is worth noting that Panama does not extradite its own citizens.
The Panama Papers were initially leaked to the German daily Suddeutsche Zeitung, which subsequently shared them with the International Consortium of Investigative Journalists. Collaborative reports were then published by various news organizations in 2016. U.S. federal prosecutors have alleged that Mossack Fonseca conspired to evade American laws, enabling their clients to preserve their wealth and conceal tax obligations to the IRS. The prosecutors claim that this scheme dates back to 2000 and involved the use of sham foundations and shell companies in Panama, Hong Kong, and the British Virgin Islands.
