Sentencing for Donald Trump’s Conviction on Falsification of Business Records Postponed Until After Election

Sentencing for former President Donald Trump’s conviction on falsification of business records related to a hush-money payment to porn star Stormy Daniels has been postponed until after the upcoming election. The decision was made by Judge Juan Merchan, who ruled that the sentencing hearing, if necessary, will take place on November 26, 2024, at 10 am.

In his ruling, Judge Merchan emphasized the importance of maintaining the public’s confidence in the integrity of the judicial system. He stated that the sentencing hearing should solely focus on the jury’s verdict and the consideration of aggravating and mitigating factors, free from any distractions or distortions. The judge also highlighted the diligent service of the jury members and stressed the need to respect and address their verdict without being overshadowed by the magnitude of the presidential election.

Donald Trump was found guilty in May on 34 felony counts of falsifying business records, stemming from a hush-money payment made to Stormy Daniels to conceal news of an alleged affair prior to the 2016 election. However, the Manhattan District Attorney’s office agreed to postpone the sentencing following a Supreme Court decision that granted presidents immunity from prosecution for official acts committed while in office.

Trump’s attorneys argued that holding the sentencing before the election would result in politically prejudicial proceedings that could be used to attack his campaign for the presidency. Judge Merchan’s decision to adjourn the sentencing aims to dispel any suggestions of favoritism or disadvantage towards any political party or candidate.

The Supreme Court ruling on presidential immunity has cast doubt on several criminal cases against Trump. In July, a federal classified documents case against him was dismissed by Florida Judge Aileen Cannon, a decision that has been appealed by the Justice Department. Additionally, Special Council Jack Smith recently issued a superseding indictment against Trump in relation to the DOJ’s other criminal case concerning his efforts to overturn the 2020 presidential election results. Despite the commitment of prosecutors to pursue these cases, a potential victory in the election could potentially shield Trump from any consequences.
