A 26-year-old man, Dajon Daniel, who stands accused of felony kidnapping and other related charges following a domestic violence incident in a Fairfield park on March 28, has been admitted to a state mental competency treatment program. The decision was made during a “placement hearing” held in Solano County Superior Court, where Judge Wendy Getty announced that she had received a “notice of admission” to a jail-based competency treatment program.
Last month, Judge Getty had ordered Daniel’s commitment to the Department of State Hospitals, and now the jail-based program will provide him with mental health treatment due to his incompetence to stand trial caused by mental illness. These programs aim to reduce waitlists for State Hospital beds and shorten custody time.
According to Penal Code section 1368, a criminal defendant declared mentally incompetent cannot be tried, and court proceedings are suspended. However, once competency is restored, criminal proceedings can be reinstated, including a jury trial.
During the recent court proceeding, Judge Getty, referring to Penal Code Section 1370, which addresses commitment upon finding mental incompetence, ordered Daniel to be sent to one of the five state hospitals “when a bed becomes available.” The court documents also mentioned that anti-psychotic drugs may be administered voluntarily, the maximum confinement period is two years, and the hospital’s medical director must issue a progress report to the court within 90 days.
Currently, Daniel remains in the Stanton Correctional Facility in Fairfield on a no-bail hold. Deputy Public Defender Dan Messner represented him during the hearing, while Deputy District Attorney Christine De Leo appeared on behalf of Mark E. Ornellas, who leads the prosecution for the District Attorney’s Office. Daniel had previously pleaded not guilty to the charges during his jail arraignment.
Apart from the kidnapping charge, Daniel is also accused of willful cruelty to a child resulting in possible injury or death, evading a law enforcement officer with wanton disregard for safety, and battery on a spouse or former spouse or date.
The incident that led to Daniel’s arrest unfolded on March 28 when Rio Vista dispatchers received a report of a domestic violence incident in a Fairfield park. The suspect, later identified as Daniel, allegedly assaulted a woman before forcibly taking her into a car and fleeing the scene. Fairfield officers pursued Daniel, who drove recklessly, and additional calls reported his vehicle’s presence near highways 12 and 113.
Officers strategically positioned themselves at potential entry points, successfully intercepting the suspect’s vehicle as it entered Rio Vista. The arrest took place in front of the St. Joseph Cemetery without any resistance from Daniel. A woman and a 2-year-old child, who were in the vehicle, were safely freed.
Daniel was subsequently booked into jail by Fairfield officers on suspicion of felony kidnapping and other charges. His initial bail was set at $75,000. Rio Vista firefighters also responded to the incident, providing medical attention to the woman, child, and Daniel, who had sustained an unspecified injury prior to being apprehended.
