Lawsuit Against Social Media Companies Alleging Radicalization of Gunman Denied by New York Judge

A New York state judge has rejected a motion to dismiss a lawsuit filed against several social media companies, including Meta, Alphabet, Reddit, and 4chan, alleging their platforms contributed to the radicalization of a gunman responsible for a deadly shooting at a grocery store in Buffalo, New York in 2022. Court documents reveal that Erie County Supreme Court Justice Paula Feroleto determined the complaint sufficiently pleads viable causes of action to proceed with the litigation.

The judge’s decision allows the plaintiffs to move forward with their lawsuit, claiming that social media companies profit from the dissemination of racist, antisemitic, and violent content on their platforms to maximize user engagement. The lawsuit specifically points to the time then 18-year-old Payton Gendron spent on these platforms, alleging that they played a role in his radicalization. The court document states that the defendants’ platforms are more than mere message boards, as the plaintiffs argue they are sophisticated products designed to be addictive to young users and directed Gendron towards further platforms or postings that indoctrinated him with “white replacement theory.”

Attorneys representing the social media companies named in the lawsuit had filed a motion to dismiss, contending that their platforms are similar to message boards hosting third-party content. However, the judge found that it was premature to dismiss the case, stating that it is too early to determine, as a matter of law, whether the actions or inaction of the social media companies require dismissal.

CNN has reached out to Meta for comment, while YouTube spokesperson José Castañeda expressed sympathy for the victims and families affected by the attack. Castañeda mentioned that YouTube has invested in technology and policies to identify and remove extremist content. Reddit also provided a statement to CNN, emphasizing their prohibition of hate-based content and their continuous efforts to improve content detection and removal.
