Gloria Trevi’s lawsuit alleging she was a victim of “sadistic” sex abuse by her ex-manager Sergio Andrade has survived a court challenge and will proceed, ruled Judge Jared D. Moses of the Los Angeles County Superior Court on Wednesday. The decision comes after two Jane Does, who previously filed a childhood sexual assault lawsuit against Trevi and Andrade, requested the court to reject Trevi’s legal action, arguing that it lacked specificity and necessary facts.
In their demurrer motion, the Jane Does argued that Trevi’s lawsuit failed to provide specific dates and locations of the alleged abuse, as well as evidence supporting the claim that they knew Andrade was abusing Trevi. They contended that Trevi’s cross-complaint muddled the facts regarding events that occurred after Trevi turned 18, which is crucial as she is suing under a statute for adult survivors.
During the hearing, lawyer Caroline Whitlock, representing Jane Doe K.C. 1 and Jane Doe A.H. 2, emphasized the importance of connecting the dots and criticized the lack of clarity in Trevi’s cross-complaint. However, Trevi’s lawyer, Leo Presiado, argued that the cross-complaint was sufficient.
In his ruling, Judge Moses agreed with Trevi’s lawyer, stating that the cross-complaint was not incomprehensible to the point of being struck down. He cited case law supporting Trevi’s right to resolve ambiguities through discovery. The next hearing in the case is scheduled for June 5.
The lawsuit, filed by the two Jane Does on December 30, 2022, revived a scandal that had previously rocked Mexico for nearly two decades. It alleged that Trevi had procured underage girls for Andrade as part of a sex ring. Trevi, who spent four years in pre-trial detention, was acquitted of rape, kidnapping, and corruption of minors charges filed against her by Mexican prosecutors.
Jane Doe K.C. 1 claimed she was enticed into Andrade’s group at the age of 15 in 1991, while Jane Doe A.H. 2 alleged she was lured into Andrade’s world at the age of 13 in 1989. Both women accused Trevi of manipulating them into sexual encounters with Andrade while they were minors, enduring physical and mental abuse.
In her cross-complaint, Trevi sued Andrade for sexual assault and battery, alleging that he enlisted the Jane Does to perpetuate his abuse. She claimed that Andrade, with the assistance of the Jane Does and others, hid the fact that he controlled and abused a group of young women for many years.
Trevi’s cross-complaint detailed the repeated and brutal rape she endured at the hands of Andrade, which led to her attempting suicide. She described sadistic punishments, starvation, and brutal beatings. Andrade, who has not responded to the new legal actions, was convicted and imprisoned in Mexico on charges of rape, kidnapping, and corruption of minors.
