Former Aurora police officer John Haubert has been cleared of all charges by an Arapahoe County jury in connection to the brutal arrest of Kyle Vinson in 2021. The jury found Haubert not guilty on three felony charges, including attempted first-degree assault, second-degree assault, and felony menacing, as well as two misdemeanor charges of official oppression and official misconduct.
District Attorney John Kellner expressed disappointment in the verdict but acknowledged the jury’s decision. He emphasized that the acquittal does not change their commitment to seeking justice for victims and holding accountable those who commit crimes.
The incident occurred on July 23, 2021, when Haubert and his then-patrol partner, Francine Martinez, responded to a trespassing report in the 3100 block of South Parker Road. Upon encountering three men, two of them fled while Vinson remained. Body camera footage revealed Vinson complying with orders to lie on his stomach and put his hands out, repeatedly asserting his innocence and denying any wrongdoing.
Despite Vinson’s compliance, Haubert was captured on the body camera footage repeatedly hitting Vinson with his duty pistol, choking him, and making threats to kill him. It is important to note that Vinson never attempted to harm or threaten the officers. Martinez, who failed to intervene and stop Haubert’s actions, was previously sentenced to six months of house arrest.
The jury’s ruling comes after a year-long investigation and legal proceedings. The case has sparked outrage and raised concerns about police brutality and accountability.
