Federal Judge Gives Massage Therapist Two Weeks to Amend Sex Trafficking Lawsuit Against James Dolan

A federal judge has granted a massage therapist, Kellye Croft, a two-week extension to amend her sex trafficking lawsuit against entertainment mogul James Dolan. U.S. District Court Judge Percy Anderson ruled that Croft’s first amended complaint, filed in April, lacked the necessary allegations to support a claim under the federal Trafficking Victims Protection Reauthorization Act. Croft now has until July 8 to file a second amended complaint with sufficient facts to establish a viable federal claim for sex trafficking.

In his ruling, Judge Anderson agreed with Dolan’s lawyers that Croft’s complaint failed to allege that Dolan coerced her into a commercial sex act with promises of career support or advancement. The judge emphasized that there were no direct statements or promises made by Dolan to entice or coerce Croft into a sexual relationship. If Croft fails to meet the court’s deadline, her sex trafficking claim will be permanently dismissed with prejudice, meaning it cannot be filed again.

However, Croft’s separate state law claims for sexual battery and aiding and abetting sexual assault will be dismissed without prejudice, allowing her to pursue those claims in state court. Dolan’s spokesperson hailed the ruling as proof that there is no merit to any of the allegations against him, claiming that Croft’s lawyer, Douglas Wigdor, has a personal vendetta against Dolan and Madison Square Garden.

Croft’s lawsuit, initially filed in January, alleges that she was a massage therapist working for Glenn Frey of the Eagles when she first encountered Dolan in 2013. According to the complaint, Dolan, who was opening for the Eagles with his band JD & the Straight Shot, booked a massage with Croft and subsequently pressured her into unwanted sexual intercourse. Croft claims that Dolan summoned her to his room multiple times during the tour and made unwelcome advances, exploiting his power over her position on the tour.

The lawsuit further alleges that Croft was later flown to California by a company owned by Eagles manager Irving Azoff to work for the Eagles and Dolan during their residency at the Forum. Croft asserts that she was brought in for the purpose of engaging in unwanted sexual acts with Dolan, as the band already had their own personal masseuses in Los Angeles.

Additionally, Croft claims that while in Los Angeles, she encountered Harvey Weinstein at the Peninsula Hotel, where he allegedly forced his way into her room and sexually assaulted her. The lawsuit states that Dolan interrupted the assault with a phone call and was informed about what had happened. However, Croft alleges that Dolan responded in a matter-of-fact manner, acknowledging Weinstein’s troubled nature but offering little consolation or assistance in reporting the assault to authorities.

Weinstein, currently serving a 16-year sentence for rape and sexual assault, has not responded to the allegations made by Croft. Dolan’s lawyer, E. Danya Perry, maintains that there is no merit to the claims against Dolan and suggests that they are retaliatory in nature. Perry asserts that there is compelling evidence to support Dolan’s position and looks forward to presenting it in court.
