East Bay Photographer Charged with Rape During Photoshoot

Xinyu Chen, a photographer from Berkeley, has been charged with two counts of forcible rape and one count of forcible oral copulation during a photoshoot in El Cerrito last April. The charges were filed in October, according to court records. The alleged victim came forward to the police in April, accusing Chen of sexually assaulting her after they met at an El Cerrito residence for the photoshoot.

Police obtained a warrant for Chen’s arrest in June but did not serve it until October. Officers went to Chen’s Berkeley apartment to detain and interview him. During the interview, Chen reportedly admitted to sexually assaulting the woman and mentioned that he had taken photographs of her before and after the assault, authorities said. At the conclusion of the interview, Chen agreed to write an apology letter to the victim before being taken into custody.

Chen is currently out of custody after posting $300,000 bail. He has pleaded not guilty to the charges and is scheduled for a hearing on December 14.
