Ashleigh Merchant’s Motion Could Impact Trump Racketeering Case

Georgia criminal defense attorney Ashleigh Merchant is set to play a pivotal role in the high-profile racketeering case against former President Donald Trump and 18 other defendants. The case, which alleges a plot to overturn the 2020 election results in Georgia, has been led by Fulton County District Attorney Fani Willis. However, Merchant’s recent motion on behalf of her client, GOP political operative Mike Roman, has raised serious questions about a potential conflict of interest involving Willis and special prosecutor Nathan Wade.

Merchant’s motion, filed on January 8, claims that Willis had an improper relationship with Wade, who she appointed as a special prosecutor in the case. The motion argues that this relationship should disqualify Willis from the case and result in the dismissal of charges against Roman. Merchant further alleges that Wade used funds from the Fulton County DA’s Office to finance extravagant vacations with Willis.

Willis has acknowledged the existence of a relationship with Wade but has dismissed it as mere gossip that should not impact the racketeering case. However, a hearing scheduled for Thursday will determine whether their relationship constitutes a conflict of interest. The judge presiding over the Trump case, Scott McAfee, has indicated that Willis may be required to testify about the timeline of her relationship with Wade.

Merchant’s involvement in the case has thrust her into the national spotlight, potentially jeopardizing what some legal observers considered the strongest of the four criminal indictments against Trump. Four co-defendants have already pleaded guilty to various charges. Merchant, who recently assumed the presidency of the Georgia Association of Criminal Defense Lawyers, maintains that her actions are driven by a commitment to thoroughly investigate every aspect of a case in order to provide the best defense for her clients.

As the hearing approaches, Merchant remains focused and dedicated, drawing inspiration from her morning runs. Colleagues describe her as a tenacious and zealous lawyer who leaves no stone unturned. Republican lawmakers in Georgia have also expressed interest in investigating Willis, with multiple employees from the DA’s office reportedly willing to testify against her. Additionally, Willis is under investigation by Georgia’s Prosecuting Attorneys’ Qualifications Commission and has been subpoenaed by GOP Rep. Jim Jordan for documents related to allegations of whistleblower retaliation and misuse of federal funds.
